Coalition Stands Against Unjust Bond Requirement in One Big Beautiful Bill Act
The Pelican Institute Center for Justice joined 24 nonprofit litigation centers in a coalition letter to Senators John Thune and Chuck Schumer asking them to oppose a provision in H.R. 1, the One Big Beautiful Bill Act, that would have required a security bond in order to request that a court issue a temporary restraining order or preliminary injunction against the federal government. This provision would have required litigants like Brandon Trosclair or Master Sergeant Robert Galey to pay a bond in the millions or billions of dollars in order to fight against the government’s violation of their constitutional rights, effectively shutting off their ability to prevent the federal government from causing irreparable harm. Fortunately, this provision was found to violate the Byrd Rule and was struck from the bill.
